Bounce House Injuries on the Rise.

Have you ever rented an inflatable bounce house for your child’s birthday party or other celebration?  Did you know that bounce house injuries are on the rise?  A recent study published in the journal Pediatrics found that bounce house injuries have increased fifteen-fold from 1995 through 2010.  Click here to find the study.

Parents who rent bounce houses are often asked to sign waivers stating that the rental company is not responsible if a child is hurt while using the bounce house.  But, Illinois courts are reluctant to enforce a waiver of a child’s rights signed by a parent or guardian.  Courts have found that the rights of minors should be carefully guarded and parents cannot settle a minor’s cause of action without a court’s review and approval.  See e.g.,  Villalobos v Cicero School Dist 99, 362 Ill. App. 3d 704, 711-12 (1st Dist. 2005); Mastroianni v Curtis, 78 Ill. App. 3d 97, 99-100 (1st Dist. 1979).
